Food safety and consumer protection – laws and regulations

National Codex consultative mechanism

The Food Safety Agency of BiH has the capacity of legal person with the rights and obligations stipulated by the Law on Food (Official Gazette of BiH, 50/04) and the Agency Statute. The Agency was founded in order to ensure food and feed safety, to perform scientific and expert and technical operations as regulated by the Law on Food and to apply international conventions and agreements related to food and feed safety binding for BiH. The Agency is obliged to provide scientific advice and scientific and technical assistance to legislative and political structures of BiH in all areas directly or indirectly impacting food and feed safety. The Agency provides independent data on all issues within these fields and transfers data on risks. The Agency is the contact point for the Codex Alimentriues Commission activities.
Consultative mechanism in this area includes the following institutions at different administrative levels of the complex BH administrative structure:
the BiH Ministry of Foreign Trade and Economic Relations (Division for Agriculture, Food, Forestry and Rural Development, BiH Veterinary Office and BiH Plant Health Protection Administration, as administrative units of the Ministry) ;
The Ministry of Agriculture, Forestry and Water Management of the RS, the Ministry of Health and Social Welfare of the RS, the RS Administration for Inspection Affairs and inspection authorities within local self-governments,RS Public Health Institute, Public Veterinary Institute “Dr Vaso Butozan”;
FBiH Ministry of Agriculture, Water Management and Forestry, the FBiH Administration for Inspection Affairs, the FBH Agro-Mediterranean Institute, the FBiH Agricultural Institute, the FBiH Ministry of Health, the FBiH Public Health Institute, cantonal ministries responsible for agriculture, cantonal administrations for inspection affairs, cantonal services organised whether within ministries or as autonomous administrative organisations, such as agricultural institutes, veterinary institutes and public health institutes.
In the BDBiH competent authorities in this field are: the Department of Agriculture, Forestry and Water Management of the BDBiH, the Inspectorate of the BDBiH and the Department of Health Care and Other Services of the BDBiH which act in line with the State regulations in the field of food safety.
Food Safety Agency also cooperate and rely on academia in Bosnia and Herzegovina and competent laboratories as appropriate.

Risk Assessments and Scientific Data

National bodies providing risk assessment and scientific advice

Food Safety Agency contributes to a high level of protection of human life and health and takes due care of animal health and welfare, plant health and the environment on the territory of BiH and collects and analyses data in order to indicate and monitor the risks directly or indirectly impacting food and feed safety.
In addition the Agency provides: scientific advice, scientific and technical assistance regarding human nutrition in the legislation enacting process at the State level and assistance in communication regarding nutrition issues under health care programmes in BiH; scientific advice on other issues related to animal health and welfare and plant health; scientific advice on products including food and feed regarding genetically modified organisms.

Risk assessment, risk profiles, scientific opinions

In the period of 2016-2018 Agency has issued 36 risk assessments mainly concerning following risks in food/food contact materials:
aflatoxin B1
residua of pesticides and of haevy metals
foreign bodies
glyphosphate
microbiological contamination
MOAH
etc.
